FLSmidth cartel penalty on former subsidiary reduced

Company Announcement to the Danish Financial Supervisory Authority No. 13-2012, 6 March 2012

As announced in 2005 (see FLSmidth stock exchange announcement No. 30-2005 issued 1 December 2005) the European Commission then ruled that FLSmidth & Co. A/S and the subsidiary company FLS Plast A/S were to be held partly liable with regard to a cartel penalty on a formerly FLSmidth-owned French company then named Silvallac S.A (later Trioplast Wittenheim).

The General Court (court of first instance) has today reduced FLSmidth & Co. A/S' and the subsidiary company FLS Plast A/S' partly liability for this penalty. The liability is reduced from EUR 15,30m to EUR 14,45m. 

FLSmidth and its advisers will now study the decision in detail before deciding on a possible appeal to the European Court of Justice.
